Legal basis for using the Jacomoto platform.
These Terms of Use govern the relationship between Jacomoto GmbH (hereinafter "Operator") and users of the platform under the domain jacomoto.com. The platform provides information, tests, guides, and community features related to motorcycles, mobility, and modern vehicle culture. Use is only permitted upon acceptance of these terms.
The Operator reserves the right to change these terms at any time with effect for the future. Users will be informed of material changes via email. If a user does not object to the changed terms within four weeks of receiving the change notification, the new terms will be deemed accepted.
Each user undertakes to comply with applicable law when using the platform. In particular, it is prohibited to:
In the event of violations, the Operator may temporarily or permanently block the user's access. A block will be communicated to the user with reasons provided.
The Operator assumes no warranty for the accuracy, completeness, or timeliness of the content provided on the platform. This applies in particular to technical data, test reports, and instructions. Use of the content is at your own risk.
The Operator is fully liable for damages resulting from injury to life, body, or health, as well as for damages caused by intent or gross negligence. Otherwise, liability is limited to compensation for foreseeable, typical damages, unless mandatory legal provisions stipulate otherwise.
The platform may be temporarily unavailable due to maintenance work, technical disruptions, or force majeure. There is no claim to uninterrupted availability.
All content published on the platform, in particular texts, graphics, logos, and videos, is protected by copyright. Reproduction, distribution, or public communication requires the prior written consent of the Operator, unless statutory exceptions apply.
Users who publish their own content (e.g., forum posts, photos) on the platform grant the Operator a simple, temporally and spatially unrestricted right of use. The user assures that they hold all necessary rights to the content posted.
The collection, processing, and use of personal data is carried out in accordance with the privacy policy, which is available on the platform at policy.html. The Operator takes appropriate technical and organizational measures to ensure the security of the data.
Users are obliged to keep their access data confidential and to inform the Operator immediately of any unauthorized access.
Use of the platform is generally possible without time limit. The user can delete their account at any time without stating reasons. Deletion can be requested by email to info@jacomoto.com.
The Operator may terminate a user's account with two weeks' notice if the user violates essential obligations under these terms. In the event of a serious violation, termination without notice is permissible.
Should individual provisions of these Terms of Use be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid regulation that comes closest to the economic purpose.
The law of the Republic of Austria applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from or in connection with these terms is the registered office of the Operator in Austria.
